Welcome to Equine Mogul. These Terms & Conditions ("Terms") are a legal agreement between you and Visible Homes, LLC ("Equine Mogul," "we," "us," or "our"). Equine Mogul is a website owned and operated by Visible Homes, LLC.
These Terms apply to our website at equinemogul.com (and any staging or related site we operate, such as equine-mogul.webflow.io), our "Find a Specialist" referral service, our forms, and our agent education programs, including our online course, digital downloads, coaching program, referral partner network, and any future membership (together, the "Services").
Please read these Terms carefully. By using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.
You must be at least 18 years old to use our referral service, course, coaching, or other Services. Our website is not intended for children under 13. By using the Services, you confirm that you meet these age requirements and that the information you give us is true and complete.

We may suspend or end your access to the Services at any time, with or without notice, for any lawful reason, including if we believe you have broken these Terms.
When you submit a "Find a Specialist" request, our team reviews it. If we can, we connect you with a real estate agent we believe may be a good fit for your needs. By checking the consent box on the form, you agree that we may contact you about your request and share your details with that agent.
Equine Mogul may receive a referral fee from the agent we connect you with, usually if a transaction closes. This fee is paid by the agent, not by you, and is handled as allowed by applicable law. It does not change the price you pay. If you would like more information about referral fees, please contact us.
Visible Homes, LLC is a licensed real estate brokerage in Michigan. Unless you sign a separate written agreement with Visible Homes, LLC, using the Services does not create an agency, broker, or client relationship between you and Equine Mogul or Visible Homes, LLC.
Information on our website, in our course, and in our coaching is for general education and information only. It is not legal, financial, tax, investment, appraisal, inspection, zoning, or veterinary advice. Horse property involves special issues, such as zoning, water rights, land use, liability, and animal care. Always talk with qualified professionals, such as an attorney, accountant, lender, inspector, or surveyor, before making decisions.
Property details, market information, and other content on our website may not always be complete, current, or accurate.
Our online course, digital downloads, and agent login are hosted on a third-party course platform at learn.equinemogul.com. When you buy a course, digital download, coaching, or a membership, you may also need to agree to that platform's terms. Prices, payment terms, and what is included will be shown at the time of purchase. All sales are final, as explained below. You agree to pay all fees and any taxes that apply.
When you buy a course or program, we give you a personal, limited right to access and use it for your own learning and business. Access lasts for the period described at the time of purchase. If no period is stated, we will provide access for as long as we offer the course. We may update, change, or retire course content over time.
Your account is for you alone. You agree not to:
We may suspend or close accounts that are shared or misused, without a refund. You are responsible for keeping your login safe and for all activity under your account.
Coaching sessions are educational. Results depend on your own effort, market, and many other factors. We do not promise any level of income, business, or results. Any examples or success stories shared are not a guarantee of what you will achieve. Scheduling, rescheduling, and missed session rules will be shared when you sign up.
We plan to offer a membership program in the future. Additional terms for the membership will be shared when it becomes available.
All sales of our course, digital downloads, coaching, and membership are final. Please review what is included before you buy.
Nothing in this section limits any rights you have under law that cannot be waived.
If you apply to join, or are accepted into, our referral partner network, you agree that:
We may accept or decline any application, and may remove a partner agent from the network at any time.
When you send us information, messages, reviews, testimonials, or other content ("User Content"), you confirm that it is accurate and that you have the right to share it. You give us permission to use, store, and share your User Content as needed to provide the Services and as described in our Privacy Policy. If you give us a testimonial or review, you allow us to use it, with your name if you agree, in our marketing.
Please do not send us content that is illegal, offensive, or that violates someone else's rights.
The website, course, coaching materials, videos, text, graphics, logos, and the name "Equine Mogul" are owned by us or our licensors and are protected by copyright, trademark, and other laws. You may view and use our website for personal, non-commercial purposes. You may not copy, change, sell, or publish our content without our written permission.
Our website may link to or include services run by others, such as our course platform, form providers, video players (such as YouTube or Vimeo), and agent websites. We do not control these services and are not responsible for their content, terms, or privacy practices. Your use of them is at your own risk and subject to their terms.
By giving us your phone number and email address and checking the consent box, you agree that Equine Mogul, and the agent we connect you with, may contact you about your request by phone call, text message, or email, including through automated technology. Your consent is not a condition of any purchase. Message and data rates may apply. You may opt out at any time by replying STOP to a text, clicking "unsubscribe" in an email, or emailing us at wmccaig@equinemogul.com. See our Privacy Policy for details.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, WE MAKE NO PROMISES OR WARRANTIES OF ANY KIND, WHETHER STATED OR IMPLIED, INCLUDING ANY WARRANTY THAT THE SERVICES WILL BE ERROR-FREE, SECURE, OR ALWAYS AVAILABLE, OR ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not make any promises about any agent, property, transaction, or result. We are not responsible for what any agent, buyer, seller, lender, or other third party does or fails to do.
TO THE FULLEST EXTENT ALLOWED BY LAW, EQUINE MOGUL, Visible Homes, LLC, AND ITS OWNERS, OFFICERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST DATA, OR LOST BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICES OR FROM ANY DEALINGS WITH AN AGENT OR OTHER THIRD PARTY.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM RELATED TO THE SERVICES WILL NOT BE MORE THAN THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some states do not allow certain limits on liability, so some of these limits may not apply to you.
You agree to protect and hold harmless Equine Mogul, Visible Homes, LLC, and its owners, officers, employees, and contractors from any claims, losses, damages, and costs (including reasonable attorney fees) that come from: (a) your use of the Services; (b) your breaking these Terms; (c) your User Content; or (d) for partner agents, the services you provide to any client and your compliance with the law.
These Terms are governed by the laws of the State of Michigan, without regard to its conflict of law rules. Any legal action related to these Terms or the Services must be brought in the state or federal courts located in Washtenaw County, Michigan, and you agree to the jurisdiction of those courts.
Before filing any claim, you agree to first contact us at wmccaig@equinemogul.com and try in good faith to resolve the issue informally for at least 30 days.
Equine Mogul supports the Fair Housing Act and equal housing opportunity. We do not discriminate on the basis of race, color, religion, sex (including sexual orientation and gender identity), disability, familial status, national origin, or any other class protected by federal, state, or local law. We expect every agent in our network to follow all fair housing laws. We will not accept or act on any request that asks for discrimination.
We may update these Terms from time to time. When we do, we will change the "Effective Date" at the top of this page. If we make important changes, we may also tell you by email or by a notice on our website. Using the Services after changes take effect means you accept the updated Terms.
